We’re thrilled to have you on board! These terms explain how our service works, what you can expect from us, and what we expect from you. They’re here to keep everything running smoothly and make sure we’re all on the same page.
Here’s the gist: We provide reliable and fast internet for your home or business, but there are a few ground rules. Use the service responsibly, pay your bills on time, and let us know if something’s wrong. In return, we’ll work hard to deliver the best service we can, with minimal disruptions.
We’ve also got some details on what you can and can’t use the service for—things like public hosting or activities that could harm our network. If you’re ever unsure, just reach out!

General Interpretation
- Words referring to the singular include the plural and vice versa.
- Headings are just for convenience and don’t affect the meaning of the terms.
- References to clauses or schedules mean those in this agreement.
- "Party" or "Parties" refers to the people or companies agreeing to these terms.
- Documents mentioned in this agreement include any updated versions.
- References to laws include their updated, replaced, or amended versions.
- Attachments or add-ons are considered part of this agreement.
- "Writing" includes email and other electronic communication.
- Gender references apply to all genders.
- "Including" and similar terms are for examples and don’t limit the meaning.
- This agreement applies to the parties, their successors, and anyone they assign it to.
- If attachments conflict with this agreement, the attachment takes priority if it specifically says so.
- This agreement includes any applicable side agreements unless stated otherwise.
- Any errors in documents like quotes or invoices can be corrected without liability.

Scope of Agreement
- These terms apply to Brighton Fibre and the Customer, excluding any other terms unless agreed in writing.
- This agreement sets the general rules for services, with details in attachments or amendments.
- If there’s a conflict between this agreement and an attachment, the attachment takes precedence unless silent.
- Each attachment is a separate agreement for the services mentioned within it.

Term
- This agreement starts when the Customer creates a Brighton Fibre account and continues as long as at least one service or subscription is active.

Services
- Brighton Fibre will provide services in exchange for payment during the term of this agreement.
- The Customer cannot create obligations or liabilities for Brighton Fibre.
- Brighton Fibre will maintain equipment and provide reasonable technical and sales support.
- Brighton Fibre can make changes to its equipment without the Customer’s consent.
- Customers must ensure services aren’t used for unlawful purposes, including copyright infringement or offensive material.
- The Customer must cooperate with Brighton Fibre in resolving complaints or investigations.
- Third parties using the Customer’s facilities must follow these terms.

Acceptable Use Policy
- The service is intended for normal home or business use only.
- Customers must not use the service for hosting public file servers, making applications publicly accessible over the internet, or providing access to multiple external users.
- This service is not a hosting service, and customers must not use it to deliver value-added services without explicit written agreement from Brighton Fibre.
- If the service is being used for anything other than normal home or office use, Brighton Fibre may apply limits until an account review can be completed.

Limitation of Liability
- Brighton Fibre and the Customer are not responsible for indirect or consequential losses like lost profits or goodwill.
- Brighton Fibre’s liability for direct damages is limited to one month’s revenue or £1,000, whichever is lower.
- Brighton Fibre is not liable for delays or faults caused by events beyond its control.
- Brighton Fibre will not be liable for negligence except for causing death or personal injury.
- The Customer’s remedies are limited to fault correction or service replacement, at Brighton Fibre’s discretion.

Indemnity
- The Customer will indemnify Brighton Fibre against any claims or damages resulting from their or their users’ actions.
- This includes breaches of the agreement, negligence, marketing activities, or service content provided by the Customer.

Intellectual Property
- Each party keeps ownership of their intellectual property.
- Brighton Fibre owns its service numbers, equipment, and database access codes unless purchased by the Customer.
- Customer information provided by Brighton Fibre remains the Customer’s property.

Termination
- Either party can end the agreement with 30 days' notice unless stated otherwise in an order or side agreement.
- Brighton Fibre can terminate immediately for breaches, unlawful use, or regulatory complaints.
- Termination doesn’t affect any accrued rights or remedies up to the termination date.

Warranties
- Brighton Fibre does not guarantee a fault-free or uninterrupted service but will aim to minimise issues.
- Brighton Fibre does not warrant that the service will meet the Customer’s individual needs.
- The Customer acknowledges they chose the service based on its suitability for their purposes.

Confidentiality
- Both parties must keep information confidential unless required by law or already public.
- The Customer must ensure employees and agents comply with these confidentiality obligations.

General
- Changes to this agreement require written consent from both parties.
- If any part of the agreement is invalid, the rest will still apply.
- The agreement is governed by English law, and disputes go to the English courts.

Service Continuity
- Customers should report faults to connect@brightonfibre.com.
- Network-wide faults are extremely rare, but Brighton Fibre aims to resolve them within 4 hours.
- Faults within a customer’s home or business will be attended to within 1 working day.
- If Brighton Fibre determines that repeated damage to a customer’s connection is caused by the customer or external parties, Brighton Fibre reserves the right to charge for repairs after the first attendance.

Payments
- Customers must pay via Direct Debit and settle invoices promptly.
- Late payments incur interest at 10% per annum.
